Justice Rahman Oshodi of the Lagos State Special Offences Court in Ikeja has rejected an application seeking his recusal from the trial of former Central Bank of Nigeria (CBN) Governor, Godwin Emefiele.
Delivering his ruling on Monday, the judge held that the defence failed to provide any credible evidence of bias, stating that mere allegations without proof were not sufficient to justify his withdrawal from the case.
The defence team, led by Olalekan Ojo (SAN), had argued that Justice Oshodi’s handling of previous proceedings raised concerns about impartiality.
However, the prosecution, represented by Rotimi Oyedepo (SAN), countered the claim, asserting that the judge had acted fairly throughout the trial. Oyedepo maintained that the oral application was an attempt to delay the case and lacked legal merit.
After considering both arguments, the court ruled that there was no basis for recusal.
